Welcome to CalKal. These terms apply to your use of the website at calkal.app and the CalKal app (together, "the service"). By using the service you agree to these terms, so please read them.
Who runs the service
The service is operated by SZ GOLDEN LTD (אס זד גולדן בע״מ), Israeli company number 516369329, 15 Bialik St, Kiryat Ono 5520315, Israel ("we", "us"). You can reach us at hello@calkal.app.
What the service does
The website gives information about CalKal and lets you join the waitlist and contact us.
The app, once it launches, will let you photograph a meal and get an estimate of its items, amounts, calories, protein, carbs and fat; search for foods by name; track your activity, weight and progress; and get a personal daily target.
The app is still in development. Its features, launch date and launch format may change, and we do not commit to launching it on a particular date or at all. Joining the waitlist does not commit you to anything.
The service is not medical advice
CalKal is a tracking tool only. It does not give medical, nutritional or therapeutic advice, and it does not replace a doctor, dietitian or other professional.
- The values the app shows, including calories, amounts, nutrition values and targets, are estimates only. They can be inaccurate, which is why you can check and correct them before saving.
- Daily targets are calculated from general formulas and the details you enter, not from a medical assessment.
- Before making significant changes to your diet or activity, and especially if you have a medical condition, are pregnant or breastfeeding, or have a history of eating disorders, talk to a professional.
- In a medical emergency, call your local emergency number (in Israel, Magen David Adom on 101) or go to the nearest emergency room.
Your account
You may need an account to use the app. You are responsible for giving accurate details, keeping your login details safe, and telling us if you suspect unauthorized use of your account. The service is meant for people aged 13 and over.
Acceptable use
You may not use the service to:
- Break the law or violate other people's rights, including privacy and copyright.
- Upload photos or content you have no right to upload, or content that is offensive, threatening or unlawful.
- Try to get around security measures, break into our systems, reverse-engineer the app or disrupt the service.
- Collect data from the service automatically (scraping) or overload it, including automated or repeated form submissions.
- Pretend to be someone else or give false details.
If you break these terms, we may limit or end your access to the service.
Your content
The photos, log and everything else you enter in the service belong to you. You allow us to use that content only to run the service for you, as described in the privacy policy. We do not use your photos, log or any other content of yours to train AI models.
Intellectual property
The service, including the CalKal name, logo, design, text, screenshots and code, belongs to us or to those who licensed it to us. You may not copy, reproduce, distribute or use them commercially without our written permission, other than normal personal use of the service.
Pricing and payments
The app's price has not been set yet. If it includes payments or subscriptions, they will go through the App Store or Google Play, and their terms will apply as well. We will publish all the details before you are asked to pay.
Availability and changes
We work to keep the service available and working, but there may be faults, outages and maintenance. We may change, suspend or stop the service or any part of it.
Limitation of liability
The service is provided "as is", without any promise that it will suit your needs, be accurate or work without interruption. To the extent the law allows, we are not liable for indirect, consequential or special damage, including damage arising from relying on values or targets the service showed. Our total liability will not exceed the amount you paid us for the service in the 12 months before the event.
Nothing in these terms limits any right that cannot be limited by law, such as your rights under consumer protection law.
Indemnity
If you break these terms or the law and someone brings a claim against us as a result, you will cover the damage and reasonable costs we incur, provided we tell you about the claim and let you defend it.
Links and third-party services
The service may link to other companies' sites and services, such as the App Store and Google Play. We don't control them, and their own terms apply when you use them.
Governing law and jurisdiction
These terms are governed by the laws of the State of Israel only. The competent courts in Tel Aviv–Jaffa have exclusive jurisdiction over any matter related to the service.
Changes to these terms
We may update these terms, for example when the app launches. The date at the top of the page shows when they last changed. We will announce material changes on the website or in the app. Continuing to use the service after a change means you accept the updated terms.
